Win a Bespoke Ski Holiday in British Columbia Promotion (“Promotion”)
Information on how to enter and prize details forms part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions.
- Entry is open to all permanent residents of Australia and New Zealand who are 18 years of age or over. The Promoter has the right to verify the eligibility of each entrant.
- The Promotion commences at 12.01am (AEST) June 1, 2024 and closes at 11.59pm (AEST) June 30, 2024 (“Promotional Period”).
- This promotion is a game of chance. Lottery Permit Numbers: NSW Authority Number: TP/03380; Permit No’s: ACT TP 24/00901; and SA T24/686.
- To enter, individuals must, during the Promotional Period, visit www.snowsbest.com/win-british-columbia-winter-holiday (either advertised on snowsbest.com, www.Instagram.com/misssnowitallor www.facebook.com/misssnowitall and follow the prompts to the Promotion entry page; and fully complete and submit the online entry form with their personal details (legal name, country of residence, postcode and email address).
- Entries are limited to one per person. By completing the entry method, the entrant will receive one (1) entry.
- Entry and continued participation in the Promotion is dependent on the entrant following and acting in accordance with Facebook Statement of Rights and Responsibilities (https://www.facebook.com/terms.php) and the Instagram Terms of Use, (https://instagram.com/legal/terms/). This Promotion adheres to the terms and conditions set out in the Facebook promotion guidelines which can be found at: https://www.facebook.com/promotions_guidelines.php and the Instagram promotion guidelines which can be found at: https://help.instagram.com/179379842258600. Any questions or comments regarding the Promotion must be directed to the Promoter, not to Facebook and Instagram. The entrant releases Facebook and Instagram and their associated companies from all liabilities arising in respect of the Promotion. Entrants acknowledge that the Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook and Instagram.
- Employees (and the immediate family members) of agencies/companies directly associated with the conduct of this Promotion, the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. “Immediate family member” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- The draw will be conducted at Plexus, Level 4, 411 Collins St, Melbourne VIC 3000, Australia at 10.30am AEST on July 3, 2024 (using computerised random selection).
- The first valid entry drawn will win the prize specified below.
- The winner’s name will be published at com/misssnowitall, www.instagram.com/misssnowitalland www.snowsbest.com by July 4, 2024. The winner will be notified in writing within seven (7) days of the draw.
- If a draw is scheduled on the weekend or a public holiday, the draw will be conducted at the same time and location on the following business day. The Promoter will ensure each draw is open for public scrutiny and anyone may witness the draw on request. The winner of a drawn prize is determined by chance.
- The draw conductor may draw additional reserve entries in case an invalid entry or entrant is drawn.
- All reasonable attempts will be made to contact the winner.
- The prize must be claimed by 12:00pm AEST on September 4, 2024. In the event of an unclaimed prize, the prize will be redrawn on September 5, 2024 at 10.30am AEST at Plexus, Level 4, 411 Collins St, Melbourne VIC 3000, Australia. The winner of the redraw will be notified by email within two (2) business days of the redraw and published at com/misssnowitall, www.instagram.com/misssnowitall and www.snowsbest.com by September 8, 2024.
- The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements and to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
- Entries must be received by the end of the Promotional Period. The time of entry will in each case be the time the online entry is received. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
- The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.
- There is one (1) prize to be won. The prize is a CAD$15,000 (AUD$16,700, as at 22/04/24) travel voucher to put towards a ski trip to and within British Columbia for one or more travellers (at the winner’s own discretion). The voucher must be booked with British Columbia’s travel partner of choice.
The voucher is valid from November 20, 2024 – April 30, 2025.
All applicable fees, such as airport/departure taxes, security charges or other third party fees, taxes or charges are included.
- No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.
- Passports and visas are the responsibility of the winner and his/her travel companion (if applicable). The winner and his/her travel companion (if applicable) must be travelling together for all sectors of the flights, no stopovers permitted.
- The Promoter makes no representation as to the safety of Canada and it is the responsibility of the winner and his/her travel companion (if applicable) to check the travel advice issued by the Department of Foreign Affairs and Trade at www.smartraveller.gov.au and assess the safety of Canada prior to travel. It is the winner and his/her travel companion’s (if applicable) sole responsibility to ensure entry into Canada, at their own expense, including but not limited to ensuring all necessary passports are valid for 6 months from date of travel and visas, travel authorisations, medical advice and recommended vaccinations and immunisations have been obtained prior to travel.
- If a prize (or portion of a prize) is unavailable, the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and/or specification, subject to any written directions of a regulatory authority.
- Any ancillary costs associated with redeeming a voucher are not included. Any unused balance of a voucher will not be awarded as cash. Redemption of a voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
- In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with SnowsBest.com or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
- The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
- The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
- Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
- In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
- Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Consumer Guarantees Act 1993 (NZ) and/or Fair Trading Act 1986 (NZ) and the Competition and Consumer Act 2010 (Cth).
- If the winner chooses not to take their prize (or is unable to), or does not take or claim a prize within a reasonable time, as specified by the Promoter, or is unavailable, they forfeit the prize and the Promoter is not obliged to substitute the prize.
- Each prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
- For the purposes of public statements and advertisements, the Promoter may only publish the winner’s surname, initial and State/Territory or postcode of residence.
- It is a condition of accepting the prize that the winner may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize.
- If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Terms and Conditions in the event of any inconsistency. To the extent permitted by law the Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Terms and Conditions or otherwise.
- The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant’s details (including an entrant’s identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter’s discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
- The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury, expense, damage or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Promotion or using any prize/s (or recommendation). For the sake of clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death and shall not apply to any liability which cannot be excluded by law (in each case the Promoter’s liability is limited to the minimum allowable by law).
- The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone or computer user or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
- The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- Unless otherwise specified, a prize is a single event for the winner (and where applicable their guest) and cannot be separated into separate events or components.
- The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms and Conditions. In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final.
- SnowsBest.com, the Promoter and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
- If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to any written direction given under State or Territory Regulation (Australia/New Zealand).
- All entries become the property of the Promoter. Entrants’ personal information will be collected by the Promoter for the entrant to participate in this Promotion.
- Entrants’ personal information will be collected by the Promoter. By entering into this Promotion, the entrant also agrees to receive emails and electronic marketing communication from SnowsBest, and Destination British Columbia Performance regarding products and services (each a “Party”). Personal information will be stored on each Party’s database. Entrants will be given the opportunity to unsubscribe on every email a Party sends. Each Party is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and their individual privacy policy which is located at https://www.snowsbest.com/privacy-policy/(for the Promoter) and https://www.hellobc.com/legal-privacy-policy/ (for Destination British Columbia). Each privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Party holds about them and how the entrant may complain about any potential breach by the Party of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. Each Party collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants’ personal information to third parties including their contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Each Party may transfer entrants’ personal information to countries specified in their respective privacy policy. Entrants acknowledge that the Party cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering this Promotion, entrants consent to overseas transfer on these terms and agree that the Promoter is not liable for any such breach).
- Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
