First Fridays Competition (Terms and Conditions)

Information on how to enter and prize details forms part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions.

1. Entry is open to all permanent residents of Australia and New Zealand who are 18 years of age or over. The Promoter has the right to verify the eligibility of each entrant.
2. The Promotion commences at 12.01am (AEST) June 7, 2024 and closes at 11.59pm (AEST) August 8, 2024 (“Promotional Period”).

5. To enter, individuals must complete the following steps during an Entry Period:

1. • visit either one (1) of the following Instagram pages:  www.instagram.com/misssnowitall OR www.instagram.com/thenorthface_aunz;
   • locate the promotional post for the applicable Entry Period;
   • in a comment on the promotional post, tag a friend; and
   • follow both @misssnowitall and @thenorthface_aunz on Instagram.

6. Multiple entries are permitted. Each entry must tag a different friend. By completing the entry method, the entrant will receive one (1) entry.
7. Employees (and the immediate family members) of agencies/companies directly associated with the conduct of this Promotion, the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. “Immediate family member” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
8. The winners will be drawn using random selection. All draws will be held at 3/328-332 Bong Bong St, Bowral NSW 2576 at 10.30am AEST on the dates outlined below. Entries open and close for each draw on the dates/times specified in the table below. Entries for each draw will not be entered into any subsequent draw/s.

9. The first five (5) valid entries drawn in each draw will each win the prize outlined below. The winners’ names will be published on @misssnowitall’s Instagram page on within seven (7) days of the corresponding draw. Winners will be notified via Instagram within seven (7) days of the corresponding draw.
10. If a draw is scheduled on the weekend or a public holiday, the draw will be conducted at the same time and location on the following business day. The Promoter will ensure each draw is open for public scrutiny and anyone may witness the draw on request. The winner of a drawn prize is determined by chance.
11. The draw conductor may draw additional reserve entries in case an invalid entry or entrant is drawn.
12. All reasonable attempts will be made to contact each winner.
13. All prizes must be claimed by 12:00 pm AEDT on October 10, 2024.  In the event of an unclaimed prize, the prize will be redrawn on October 11, 2024 at 10.30am AEDT at Suite 14, 332 Bong Bong St Bowral, NSW 2576. The winner(s) of the redraw will be notified by Instagram within two (2) business days of the redraw and published at @misssnowitall’s Instagram page within seven (7) days of the redraw.
14. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements and to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
15. Entries must be received within an Entry Period (outlined above). The time of entry will in each case be the time the online entry is received. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
16. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.
17. There are five (5) prizes to be won in each Entry Period. The five (5) prizes in each Entry Period are 2 x $250 vouchers for The North Face online; and 2 x ski lift passes for the winner’s choice of either Thredbo or Cardrona (subject to availability) (valued at up to AUD$188). Each prize component (voucher and ski lift pass) will be awarded to the winning entrant and their tagged friend. The value of each prize is up to AUD$876.
18. The total prize pool of the Promotion is up to AUD$13,140 (up to $4,380 per Entry Period).
19. Prize Conditions:

1. • The winner may choose between Thredbo or Cardrona ski lift pass. The ski lift passes are subject to availability.
   • The winner guest acknowledges that skiing is a dangerous activity that may result in injury or death, and participate at their own risk. The winner must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Thredbo and Cardrona Alpine Resort staff as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in skiing; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of Thredbo or Cardrona staff at all times; and (e) wear all safety and other equipment required. The Promoter and either Thredbo or Cardrona staff, in their absolute discretion, at all times reserve the right to: (a) prevent any winner from participating in skiing if, at any time, they reasonably believe that the winner poses a safety risk or for any other reason; and/or (b) cancel skiing at either Thredbo or Cardrona if the conditions are deemed dangerous.
   • All costs associated with travel to and from the either Thredbo or Cardrona will be the responsibility of the winner.
   • Any ancillary costs associated with redeeming a voucher are not included. Any unused balance of a voucher will not be awarded as cash. Redemption of a voucher is subject to any terms and conditions of the issuer including those specified on the voucher.

20. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
21. If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize within a reasonable time, as specified by the Promoter, or is unavailable, they forfeit the prize and the Promoter is not obliged to substitute the prize.
22. No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.
23. If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and/or specification, subject to any written directions of a regulatory authority.
24. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
25. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
26. For the purposes of public statements and advertisements, the Promoter may only publish the winner’s surname, initial and State/Territory or postcode of residence.
27. Entry and continued participation in the Promotion is dependent on the entrant following and acting in accordance with the Instagram Terms of Use, (http://instagram.com/legal/terms/). This Promotion adheres to the terms and conditions set out in the Instagram promotion guidelines which can be found at: http://help.instagram.com/179379842258600. Any questions or comments regarding the Promotion must be directed to the Promoter, not to Instagram. The entrant releases Instagram and its associated companies from all liabilities arising in respect of the Promotion. Entrants acknowledge that the Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram.
28. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
29. It is a condition of accepting the prize that a winner may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize.
30. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Terms and Conditions in the event of any inconsistency. To the extent permitted by law the Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in Terms and Conditions or otherwise.
31. Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
32. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it from the start on the same conditions, subject to any written directions given under State or Territory Regulation.
33. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant’s details (including an entrant’s identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter’s discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
34. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms and Conditions. In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final.
35. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Consumer Guarantees Act 1993 (NZ) and/or Fair Trading Act 1986 (NZ) and the Competition and Consumer Act 2010 (Cth).
36. The Promoter and its associated agencies and companies shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect, special or consequential loss or loss of profits), expense, damage, death or for any personal injury suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation). For the sake of clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death and shall not apply to any liability which cannot be excluded by law (in each case the Promoter’s liability is limited to the minimum allowable by law).
37. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone or computer user or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
38. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
39. com, the Promoter and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
40. If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Promotion, subject to any written direction given under State or Territory Regulation.
41. All entries become the property of the Promoter. Entrants’ personal information will be collected by the Promoter for the entrant to participate in this promotion.
42. Winners’ personal information will be collected by the Promoter. Personal information will be stored on the Promoter’s database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at https://www.snowsbest.com/privacy-policy/. The Promoter’s privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about winners to enable them to participate in this Promotion and may disclose the entrants’ personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion. If any winner does not provide their personal information as requested, they may be ineligible to claim a prize in the Promotion. Personal information collected from winners will not be disclosed to any entity located outside of Australia.
